Public notice

We are required by the Environment and Safety Information Act 1988 to maintain a public register of certain fire safety notices.

The law requires us, as an enforcing authority for fire safety legislation, to make information about relevant notices available on a public register.

The register includes:

• Alterations notices
• Enforcement notices
• Prohibition notices

These are legal documents that place requirements or restrictions on the person or organisation the notice has been issued to.

The National Fire Chiefs Council (NFCC) Enforcement Register provides information about registered enforcement companies operating within recognised industry standards.

An enforcement notice may require someone to take specific action to improve fire safety. A prohibition notice can restrict or prevent the use of premises where there is a serious risk to people.

If you have been served with a notice and believe that information in the register could reveal a trade or manufacturing secret, you can tell us in writing within 14 days of the notice being served.

If we receive a notification, we will:

1. Consider the information concerned.
2. Amend the notice where appropriate.
3. Send a draft entry to the person affected.

If you disagree with the proposed entry, you can appeal to the Secretary of State within 14 days.

If a notice has been successfully appealed under Section 4(1)–(4) of the Environment and Safety Information Act 1988, we will clearly redact (remove) the relevant sensitive information from the register.

We maintain the register with information about notices that have been served. Each entry contains enough information to explain the substance of the notice.

Notices will normally remain on the register for three years. However, they may remain available for longer if they:

• Are still in force
• Have not been complied with
• Have not been withdrawn by us

Relevant notices are also subject to our publication scheme and may be available on request.
