The enforcement register
Enforcement register - what we do
Hampshire Fire and Rescue Authority is required by the Environment and Safety Information Act 1988 to maintain a public register of notices (download a copy of the Environment and Safety Information Act 1988 from the Office of Public Sector Information website). The Act requires authorities, to which this Act applies, to establish a public register of relevant notices served concerning health, safety, environmental protection and related issues. As an enforcing authority of fire safety legislation, Hampshire Fire and Rescue Authority will maintain a public register of notices served.
These notices are:
- Alterations Notices,
- Enforcement Notices and
- Prohibition Notices.
Relevant Notices are legal documents placing either restrictions or requirements on the person on whom the Notice has been issued.
The register
- Notices served from 1st April 2009 can be viewed electronically on the website of the Chief Fire Officers Association.
- Notices served prior to the 1st April 2009 will be maintained in hard copy at our Service Headquarters.
- All notices may be inspected free of charge at any reasonable time by contacting the enforcement team.
- Hampshire Fire and Rescue Service will maintain the register, which will contain information relating to notices served. Each entry on the register will state sufficient particulars to convey the substance of the notice to which it relates.
- Notices will be held in the register for a period of not less than 5 years. After which the relevant notices will be subject to the Hampshire Fire and Rescue Service's publication scheme and may be available upon request.
- Persons on whom notices are served have a right to give written notification to the Fire and Rescue Authority within 14 days following the date of the service, that they think the entry may reveal a trade or manufacturing secret. Where such notification is received, the Fire and Rescue Authority will amend the notice and send a draft entry to the person affected. Should the person affected disagree with the proposed entry he/she may, within 14 days, appeal to the Secretary of State.
- Notices which have been sucessfully appealed under Section 4 (1)-(4) of the Environment and Safety Information Act 1988 will be clearly redacted (edited to remove sensitive information) to demonstrate compliance.
- The Community Safety (Protection) Department at the Headquarters of the Hampshire Fire and Rescue Service will ensure that the information held is current.
