8.6 Compensation for Loss of Retained Earnings

Guidance: Where retained members of staff suffer injury or disease, which is not their fault, arising out of authorised duty, the Service will consider claims for reimbursement of loss of retained earnings incurred during the period of absences.

Rate: Compensation is payable for fire calls received at the station to which the individual would normally have responded had they been fit for duty. Compensation is calculated using a standard formula based on the individual’s performance during the previous calendar year, i.e.: Total station calls for previous year = 164

Responded to by individual for previous year 124 = 75.6%

Which breaks down to 95 T = 58% & 29 A = 17%

Total calls at station during period of absence =41

Applying previous years average of 75.6% = 31 calls

Which breaks down to 58% of 41 = 24 T & 17% of 41 = 7 A

8.7 Compensation for Loss of Drill Night Earnings

Guidance: Where retained members of staff suffer injury or disease, which is not their fault, arising out of authorised duty, the Service will consider claims for reimbursement of loss of drill night fees incurred during the period of absences.

All drill night fees missed can be reimbursed in full.

8.8 Compensation For Loss Of Primary Employment Earnings

Guidance: Where retained members of staff suffer injury or disease, which is not their fault, arising out of authorised duty, the Service will consider claims for reimbursement of loss of earnings primary employment incurred during the period of absences.

  

  

Rate

If a retained member’s primary employer reduces or ceases pay because of absences due to a Service injury compensation is payable. The rate will be the pay of a wholetime member holding the same rank and having the same service in the rank. Where a member provides evidence that pay from their primary employment is greater than that of the wholetime equivalent, payment up to a maximum of the highest point of a Station Officer’s scale, less the retaining fee for the period claimed.

8.9 Payment To Retained Staff Attending Courses

Guidance: A retained member of staff who is required to attend a central training establishment or a local training centre will be entitled to the allowances laid out in section VII paragraph 14 of the Grey Book.

  

  

Rate

The rate will be the pay of a wholetime member holding the same rank and having the same service in the rank. Where a member provides evidence that pay from their primary employment is greater than that of the wholetime equivalent, payment up to a maximum of the highest point of a Station Officer’s scale.

For retained recruits course and retained BA initial courses payment will be made via the pay roll and it is not necessary to submit form FM/1/2/2/1. However, if additional travelling time is incurred to attend the course this may be claimed at an hourly rate on an FM/1/2/2/1 using code W as long as full details are given on the form.

8.10 Payment To A Whole Time Member Of Staff Undertaking Retained Duties

Guidance: Wholetime member of staff taking on Retained Duties will commence at the bottom of the salary rate, progressing to the 'after three years service salary', after completing three years retained service.

8.11 Long Service Bounty Scheme

Guidance: The Long Service Bounty Scheme is designed to recognise, reward and encourage continuous retained service. Long Service Bounties are payable to Wholetime members who undertake retained duties (this is due to be reviewed in 2006).

8.13 Retained Maternity, Paternity, and Adoption Pay

Guidance: Maternity Support Leave, Paternity/Adoption Leave

Maternity support leave/adoption leave of 2 weeks, or 2 tours of duty, shall be granted to the child's father or the partner or the nominated carer at, or around, the time of birth. (subject to review by April 2003 see below)Generally, maternity support leave will be taken within 4 weeks of the time of the birth.Employees wishing to take maternity support leave should apply by memorandum to their Station Commander/Line Manager giving an estimate of the likely timing of their absence and attaching a copy of form MATB1 which the mother may obtain from her GP or Midwife.Adoption leave is treated the same as maternity support leave.

Retained employees may claim the payments using the FM/1/2/2/1 form:

When an individual is unable to report for a training period (drill) by reason of taking approved maternity support leave/adoption leave payment for the three hour training period may be claimed by using code PA.Claim for the loss of attendance and turnout calls that the employee would realistically have made during this period may also be claimed.

Wef 6/4/2003 statutory rights:

Subject to certain conditions being satisfied, an employee will be entitled to two weeks’ statutory paternity leave from 6/4/2003.Subject to certain conditions being satisfied, an employee will be entitled to two weeks’ statutory paternity pay from 6/4/2003.An employee entitled to statutory paternity leave may not be entitled to statutory paternity pay. ( refer to criteria for eligibility)An employee will have to take their statutory paternity leave in a single block of either one or two weeks ( a week is defined as a period of 7 days)An employee taking statutory paternity leave for a newly-born or newly-adopted child will have to do so before the end of a period of 56 days beginning with the date of the child’s birth or date of the adopted child’s placement.A foster father will not be entitled to take statutory paternity leave and pay if they have exercised their right to statutory adoption leave and pay.Employers will be able to recover statutory paternity pay (SPP) in the same way as they currently recover statutory maternity pay. (SMP).From 6/4/2003, subject to certain conditions being satisfied, an employee may be entitled to six months paid adoption leave and six months unpaid leave for the purposes of caring for a newly-adopted child up to the age of 18 years. The other parent will be able to take two weeks’ paid ‘paternity’ leave.

9. Dismissal of an employee for exercising any of their rights in relation to statutory paternity or adoption leave will be deemed to be automatically unfair.

8.14 Retained Recruits Travelling To Medicals

Guidance: Payable to new recruits travelling to and from their medical appointment with the Occupational Health Unit. The time taken travelling to and from this appointment may be included in the overall time claimed.

Form FM/1/2/2/1 should be completed by the individual and authorised by the Officer In Charge. Code W should be used.

8.15 Retained OIC Administration allowances

Guidance: Payable in respect of Station Administration duties carried out by authorised Personnel on retained stations and retained units on Wholetime or Day Crewed stations. Administration duties may be delegated to any member of the unit.

Amount payable is 3 hours for retained station or 2 hours for retained sections on Wholetime/Day Crewed/Weekly stations.

8.16 Retained Station Cleaning & Maintenance Allowances

Guidance: Payable in respect of routine weekly cleaning and maintenance duties undertaken on station. The time should not exceed 4 hours per week on a one-pump station and 8 hours per week on a two-pump station, or as directed by ADO (OPS).

8.17 Jury Service (Retained)

Guidance: Employees are not able to claim any payment for loss of attendance or turnout fees from HFRS. Employees will receive details from the Court Services office on the claims procedure for loss of earnings.

8.18 Acting Up Allowance for Retained Crew Commanders

Guidance: Where a retained appliance turns out to a fire or other occurrence and the members of the crew are all of firefighter rank, a suitably qualified member may be designated in charge of the appliance and be paid an acting up allowance in respect of the turn out fee and extra payments for remaining on duty.

Rate: Shall be equal to the difference between the fees applicable to the ranks of firefighter and leading firefighter respectively.
